This Privacy Policy explains how Borrowing Tape Pty Ltd (“we”, “us”, “Company”) collects, uses, and handles personal information in accordance with the Privacy Act 1988 (Cth), the General Data Protection Regulation (GDPR), UK GDPR, and other applicable data protection laws. This Policy should be read alongside the Contributor Agreement (Version 1.0), which governs the submission of content to the Borrowing Tape platform.
1. DATA COLLECTION
(a) General Visitors. We do not require account registration or intentionally collect personal information from general visitors. However, we may automatically collect limited technical data (such as IP address, browser type, and device information) for security and operational purposes.
(b) Contributors. When you submit content and accept the Contributor Agreement (Version 1.0), we collect:
- full name and preferred byline (if different);
- email address;
- submission metadata, including IP address, timestamp, and Agreement version number accepted; and
- any other information you voluntarily provide in connection with your submission.
This information is collected at the point of acceptance of the Contributor Agreement via the electronic acceptance mechanism described in clause 15 of that Agreement.
2. PURPOSE AND LEGAL BASIS FOR PROCESSING
We process personal information for the following purposes:
(a) Contract Performance. To administer the Contributor Agreement (Version 1.0), including verifying identity, managing intellectual property assignment, and maintaining records of rights ownership. This is necessary for the performance of the contract between us.
(b) Legitimate Interests. We process data where necessary for:
- recordkeeping of intellectual property ownership and assignment;
- fraud prevention and platform security;
- legal enforcement of rights under the Contributor Agreement; and
- maintaining evidence of electronic acceptance of the Contributor Agreement, including timestamp, IP address, and Agreement version.
Where we rely on legitimate interests as our legal basis, we ensure that our interests are not overridden by your fundamental rights and freedoms.
(c) Legal Compliance. We may process and retain data where required to comply with applicable legal obligations, including obligations arising under the Privacy Act 1988 (Cth), GDPR, UK GDPR, and any other applicable law.
3. STORAGE AND INTERNATIONAL TRANSFERS
Our systems may store data on servers located outside Australia, including in the United States. By using the Platform or submitting content, you acknowledge and consent to this transfer, subject to appropriate safeguards consistent with applicable law.
For EU/EEA and UK contributors, where personal data is transferred outside those regions, we ensure that appropriate safeguards are in place in accordance with GDPR and UK GDPR requirements, including standard contractual clauses or equivalent mechanisms where required.
4. COOKIES AND TRACKING
We may use cookies and similar technologies for:
- site functionality and user experience;
- security and fraud prevention; and
- basic analytics and performance monitoring.
You may disable cookies through your browser settings, although some features of the Platform may not function properly as a result.
5. RETENTION
We retain personal information and Contributor Agreement records for as long as:
- the submitted Works are used or stored by us;
- required by law, legal obligation, or legitimate business purposes; or
- necessary to evidence the intellectual property assignment under the Contributor Agreement.
Contributor Agreement acceptance records (including name, email, IP address, timestamp, and Agreement version) are retained indefinitely as evidence of rights assignment, consistent with clause 13 of the Contributor Agreement. After the applicable retention period for other data, personal information is securely deleted or anonymised where appropriate.
6. YOUR RIGHTS
Depending on your location and applicable law, you may have the right to:
- request access to your personal information;
- request correction of inaccurate or incomplete data;
- request deletion of your personal information where legally permissible;
- object to or restrict certain processing activities; and
- data portability (where applicable under GDPR or UK GDPR).
Please note that the right to deletion does not extend to Contributor Agreement acceptance records, which we are entitled to retain as evidence of intellectual property assignment under the Contributor Agreement (Version 1.0) and applicable law.

7. DATA SECURITY
We take reasonable technical and organisational measures to protect personal information from unauthorised access, loss, misuse, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. POLICY HIERARCHY
In the event of any inconsistency between our policies, the following order of precedence applies:
- Contributor Agreement (Version 1.0) — governs intellectual property ownership and assignment matters;
- this Privacy Policy — governs data protection and personal information matters; and
- Terms of Service — governs general platform use.
9. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time. Where changes are material, we will provide notice in accordance with clause 18 of the Contributor Agreement, including at least 30 days’ written notice via email or prominent notice on the Platform. The current version of this Policy is always made available on the Platform prior to acceptance of the Contributor Agreement.
